4.3 Content Restrictions

You agree not to post or transmit content that:

• Is illegal, harmful, threatening, abusive, or defamatory
• Infringes intellectual property or privacy rights
• Contains viruses or malicious code
• Is spam or unsolicited advertising
• Is false, misleading, or deceptive

5. Ticket Purchases

5.1 Ticket Sales

When you purchase tickets through our Platform:

• You agree to pay the stated price plus any applicable fees
• Your purchase is subject to availability
• We reserve the right to limit quantities and refuse service
• Tickets are non-transferable unless explicitly allowed by the event organizer

5.2 Payment Processing

We use third-party payment processors including Stripe, MTN Mobile Money, and Orange Money. Your payment information is subject to those providers' terms and privacy policies.

5.3 Refunds and Cancellations

Refund and cancellation policies are determined by event organizers. We are not responsible for issuing refunds unless required by law or our refund policy. Please review the event's specific refund policy before purchasing.

5.4 Ticket Transfer

Our Platform may offer ticket transfer functionality. When you transfer a ticket:

• The transfer must comply with the event organizer's policies
• You are responsible for ensuring the recipient's information is accurate
• Once transferred, you no longer have rights to the ticket
• The recipient will be notified and must accept the transfer

6. Event Organizers

6.1 Organizer Accounts

If you create events as an organizer, you agree to:

• Provide accurate event information and comply with all applicable laws
• Honor all ticket sales and deliver the advertised event
• Maintain appropriate insurance and licenses
• Handle customer service and support for your events
• Comply with our organizer guidelines and policies
• Process refunds in accordance with your stated policy

6.2 Event Content

Event organizers are solely responsible for:

• The accuracy of event descriptions, dates, times, and locations
• Compliance with laws regarding event promotion and ticket sales
• Any content, images, or materials uploaded to the Platform
• Managing attendee lists and check-in processes

6.3 Payment and Fees

Event organizers agree to pay our platform fees as set forth in our fee schedule. We reserve the right to modify our fee structure with reasonable notice.

7. Intellectual Property

7.1 Our Intellectual Property

The Platform and its content, features, and functionality (including but not limited to software, text, graphics, logos, images) are owned by TicketJama and are protected by copyright, trademark, and other intellectual property laws.

7.2 User Content

By posting content on the Platform, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content in connection with operating the Platform.

7.3 Copyright Infringement

We respect intellectual property rights. If you believe content on our Platform infringes your copyright, please contact us with details of the alleged infringement.

8. Privacy and Data Protection

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

Key privacy practices include:

• We collect information you provide and usage data
• We use Google reCAPTCHA Enterprise for security and fraud prevention
• When you use social login (Google or Facebook), we receive basic profile information
• We implement strong security measures to protect your data

9. Third-Party Services

Our Platform integrates with third-party services including:

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the Platform will be uninterrupted, secure, or error-free
• That defects will be corrected
• The accuracy, reliability, or completeness of content

We do not endorse, guarantee, or assume responsibility for:

• The quality, safety, or legality of events listed on the Platform
• The accuracy of event information provided by organizers
• The conduct of event organizers or attendees

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TICKETJAMA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages arising from your use or inability to use the Platform
• Damages arising from events, including event cancellations or changes
• Damages arising from unauthorized access to your account

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim or $100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless TicketJama and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the Platform
• Your violation of any rights of another party
• Events you organize (for event organizers)
• Content you post or transmit through the Platform

13. Dispute Resolution

13.1 Informal Resolution

Before initiating formal proceedings, we encourage you to contact us to seek informal resolution of any disputes.

13.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TicketJama operates, without regard to conflict of law principles.

13.3 Arbitration

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you through the Platform or by email for material changes
• Provide you reasonable time to review the changes

Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to the Platform:

• For violation of these Terms
• For fraudulent, abusive, or illegal activity
• At our discretion with or without notice

Upon termination:

• Your right to use the Platform will immediately cease
• We may delete your account and content
• You remain responsible for all charges incurred before termination
• Provisions that should survive termination will remain in effect

16. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TicketJama regarding the Platform.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

16.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and TicketJama as a result of these Terms or your use of the Platform.
